Please read these terms carefully before registering for or participating in MX5 Cup events

These Terms and Conditions (“Terms”) govern participation in the MX5 Cup championship and your use of this website, operated by Motor Racing Australia Pty Ltd (“Motor Racing Australia”, “we”, “us”, or “our”). By accessing this website or entering an MX5 Cup event, you agree to be bound by these Terms.
If you do not agree with these Terms, you must not use this website or register for our events.
1. Acceptance of Terms
By registering for or participating in any MX5 Cup event, you acknowledge that you:
- Have read and understood these Terms in full
- Are at least 18 years of age, or are participating with the written consent of a parent or legal guardian
- Hold a current, valid motorsport licence appropriate to the category
- Have provided accurate and complete information in your entry
- Agree to comply with all applicable laws, Motorsport Australia regulations, and MX5 Cup Sporting and Technical Regulations
2. Event Registration and Entry
2.1 Eligibility
To compete in MX5 Cup, participants must hold a current Motorsport Australia licence, hold or obtain the required competition licence grade for the event, have a vehicle that complies with the MX5 Cup Technical Regulations, and meet any age or experience requirements specified in the Supplementary Regulations for the relevant event.
2.2 Entry Fees
All entry fees are payable in full at the time of submission, in Australian dollars, unless otherwise advised. Entry fees are generally non-refundable after the closing date for entries. Refunds or credits may be considered at our discretion where extraordinary circumstances apply and written notice is provided prior to the event.
2.3 Acceptance of Entries
Motor Racing Australia reserves the right to refuse, cancel, or withdraw any entry at its absolute discretion, including where a participant fails to meet eligibility requirements or has breached these Terms or event regulations at a prior event.
3. Safety, Risk, and Liability
3.1 Assumption of Risk
IMPORTANT NOTICE
Motorsport is an inherently dangerous activity. By participating in MX5 Cup events, you acknowledge and voluntarily accept all risks associated with motorsport, including but not limited to collision, mechanical failure, serious personal injury, death, and damage to property.
3.2 Waiver and Indemnity
To the fullest extent permitted by applicable law, you release, indemnify, and hold harmless Motor Racing Australia Pty Ltd, MX5 Cup, their respective officers, employees, volunteers, officials, sponsors, circuit operators, and affiliated organisations from any and all claims, liabilities, damages, costs, and expenses (including legal costs on a full indemnity basis) arising directly or indirectly from your participation in any MX5 Cup event, including where caused by the negligence of any released party, except where prohibited by law.
3.3 Insurance
Participants are responsible for ensuring they hold appropriate personal accident insurance and public liability insurance for event participation. While event insurance may be in place, Motor Racing Australia makes no representations as to the adequacy of such cover for any individual participant's circumstances.
3.4 Medical Fitness
By entering, you declare that you are medically fit to participate and are not aware of any condition that would make your participation unsafe. You agree to notify event officials of any relevant medical condition prior to the event. Motor Racing Australia reserves the right to exclude any person from participation on medical grounds.
4. Event Regulations and Officials
All participants must comply at all times with:
- The MX5 Cup Sporting Regulations and Technical Regulations
- The Supplementary Regulations for each event
- Motorsport Australia National Competition Rules (NCRs)
- Circuit-specific rules and safety requirements
- Instructions from the Clerk of Course, Race Director, and other officials
- All flag signals and race control directives
Decisions of officials are final. Protests and appeals must be lodged in accordance with the procedures set out in the Supplementary Regulations and the Motorsport Australia NCRs.
5. Vehicle Requirements
MX5 Cup is a control-class series for Mazda MX-5 vehicles. All competing vehicles must:
- Comply fully with the current MX5 Cup Technical Regulations
- Pass pre-event scrutineering and technical inspection
- Display a current and valid log book issued by Motorsport Australia
- Display correct race numbers and any required markings or signage
- Meet all mandatory safety equipment requirements
Any vehicle that fails scrutineering will not be permitted to compete until deficiencies are rectified and the vehicle is re-presented and approved by the Chief Scrutineer.
6. Code of Conduct
All participants, team members, and guests must conduct themselves in a professional and sportsmanlike manner at all times. The following conduct is not permitted and may result in exclusion or suspension:
- Dangerous, reckless, or aggressive driving on or off the circuit
- Abusive, threatening, or discriminatory behaviour toward officials, other participants, or spectators
- Participation while under the influence of alcohol or prohibited substances
- Any conduct that brings Motor Racing Australia or MX5 Cup into disrepute
7. Cancellations, Postponements, and Force Majeure
Motor Racing Australia reserves the right to cancel, postpone, or modify any event due to adverse weather conditions, safety concerns, insufficient entries, circuit unavailability, government directives, or any event beyond our reasonable control (force majeure).
In the event of cancellation, Motor Racing Australia will endeavour to provide a full or partial refund of entry fees or offer a transfer to a future event. Where an event is modified or shortened due to circumstances beyond our control, no refund entitlement arises.
8. Media Rights and Image Release
By entering an MX5 Cup event, you grant Motor Racing Australia a non-exclusive, royalty-free licence to use your name, likeness, image, and vehicle in photographs and video footage taken at events for the purposes of promoting MX5 Cup and Motor Racing Australia, including on our website, social media, and in printed materials.
All logos, trademarks, event branding, and content published on this website are the property of Motor Racing Australia or their respective owners. No content may be reproduced or used without prior written consent.
9. Website Use
You may use this website for lawful purposes only. You must not:
- Attempt to gain unauthorised access to any part of the website or its systems
- Transmit viruses, malware, or any harmful code
- Scrape or harvest data without permission
- Use the website to harass, impersonate, or defraud any person
- Post or transmit any unlawful, defamatory, or offensive content
10. Limitation of Liability
To the maximum extent permitted by law, Motor Racing Australia's liability to you for any loss or damage arising from your use of this website or participation in our events is limited to the amount of the entry fee paid by you for the relevant event.
Motor Racing Australia is not liable for any indirect, special, consequential, or punitive loss or damage, loss of profits or revenue, or loss of data, whether arising in contract, tort (including negligence), or otherwise, even if we have been advised of the possibility of such loss. Nothing in these Terms limits any rights you may have under the Australian Consumer Law that cannot be excluded by agreement.
11. Privacy
Your personal information is handled in accordance with our Privacy Policy, which forms part of these Terms. By participating in our events or using this website, you consent to the collection, use, and disclosure of your personal information as described in that policy.
12. Governing Law
These Terms are governed by and construed in accordance with the laws of New South Wales, Australia. You submit to the non-exclusive jurisdiction of the courts of New South Wales and any courts competent to hear appeals from those courts.
13. Changes to These Terms
We may update these Terms at any time. The revised Terms will be published on this page with an updated “Last updated” date. Your continued use of this website or participation in events after changes are published constitutes acceptance of the revised Terms.
